Digital Sunset Terms of Service

These Terms of Service (“Terms”) govern your use of the Digital Sunset mobile application (“Digital Sunset,” “the app,” “we,” “us”) provided by Next Apps LLC, a Delaware limited liability company. By downloading, installing, or using Digital Sunset, you agree to be bound by these Terms. If you do not agree, please do not use the app.

1. License

Subject to your compliance with these Terms, Next Apps LLC grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use Digital Sunset on devices you own or control, solely for your personal, non-commercial use.

These Terms apply to the app itself regardless of where you obtain it. Your use of Digital Sunset is also subject to the Apple App Store’s Licensed Application End User License Agreement (“Apple EULA”), which is incorporated by reference into these Terms. In the event of a conflict between these Terms and the Apple EULA, these Terms control with respect to the Digital Sunset app to the extent permitted.

2. How Digital Sunset works — important to understand

Digital Sunset applies friction-based restrictions, not unbreakable locks. This is a deliberate design choice and you should understand it before relying on the app.

  • Restrictions are enforced by iOS Screen Time (through Apple’s Family Controls, Managed Settings, and Device Activity frameworks). You grant the app this authority, and you can revoke it at any time through iOS Settings → Screen Time.
  • Digital Sunset deliberately provides an override flow (a reflection prompt plus a short delay) so that you can bypass restrictions when something is genuinely urgent. This flow is not intended to be insurmountable.
  • Digital Sunset is a tool to support self-regulation. It is not a substitute for medical, psychological, or professional advice, and it makes no representation that it can prevent compulsive device use, sleep disorders, or any other condition.

3. Acceptable use

You agree not to:

  • Use Digital Sunset in any manner that violates applicable law.
  • Attempt to reverse engineer, decompile, or extract the source code of Digital Sunset, except as permitted by applicable law.
  • Use Digital Sunset to manage or restrict the device of another adult individual. Digital Sunset is designed for .individual authorization, meaning you are managing your own device.
  • Remove, obscure, or alter any proprietary notices (including copyright notices) contained in the app.

4. Disclaimer of warranties

DIGITAL SUNSET IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXT APPS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OPERATION.

Without limiting the above, we do not warrant that Digital Sunset will (a) always block every app you intend to block, (b) always deliver notifications on time, (c) always ring the wake-up alarm at the configured time, or (d) remain free from bugs or interruption. Screen Time APIs have known iOS-version-specific behaviors that are outside our control.

5. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXT APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF DIGITAL SUNSET, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In any case, our aggregate liability arising out of or relating to these Terms or Digital Sunset shall not exceed the amount you have paid us for Digital Sunset in the twelve (12) months preceding the claim, or fifty U.S. dollars ($50.00), whichever is greater.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

6. Intellectual property

Digital Sunset, including its name, design, logo, source code, and content, is owned by Next Apps LLC and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights in the Digital Sunset intellectual property other than the license expressly granted in Section 1.

7. Updates

We may update Digital Sunset from time to time. These updates may be automatically installed through the App Store under its normal update behavior. We may also update these Terms; if we do, we will post the updated version with a new effective date. Material changes that adversely affect your rights will be announced in the app before taking effect.

8. Termination

You may stop using Digital Sunset at any time by uninstalling it. We may terminate or restrict your license to Digital Sunset if you materially breach these Terms. Sections that by their nature should survive termination (including Sections 4, 5, 6, and 10) will survive.

9. Third-party services

Digital Sunset relies on Apple operating system frameworks (FamilyControls, ManagedSettings, DeviceActivity, AlarmKit, and others) whose behavior is defined and maintained by Apple. Changes made by Apple to these frameworks may affect Digital Sunset’s behavior. We are not responsible for those frameworks beyond our reasonable integration with them.

10. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or Digital Sunset shall be resolved in the state or federal courts located in Delaware, and you consent to the exclusive jurisdiction and venue of those courts.

If you are a consumer and a mandatory law of your country of residence grants you additional rights that cannot be waived by contract, nothing in these Terms affects those rights.
